Terms of Service

1. Acceptance of Terms

By accessing or using Gapli ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms constitute a legally binding agreement between you and Gapli.

2. Description of Service

Gapli is a booking management platform that connects service businesses ("Business Users") with their customers ("Customer Users"). The Platform allows Business Users to manage their schedules, services, and bookings, and allows Customer Users to discover and book services.

3. Account Registration

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must promptly notify us of any unauthorised access to your account
  • One person or entity may not maintain more than one account of the same type

4. Business User Obligations

As a Business User, you agree to:

  • Provide accurate business information, including services, pricing, and availability
  • Honour bookings made through the Platform
  • Comply with all applicable laws and regulations in your jurisdiction
  • Maintain appropriate licences and insurance for your services
  • Respond to customer enquiries and booking requests in a timely manner
  • Not use the Platform to engage in fraudulent, misleading, or deceptive practices

5. Customer User Obligations

As a Customer User, you agree to:

  • Attend bookings or cancel within a reasonable timeframe
  • Provide accurate contact information
  • Pay for services as agreed at the time of booking
  • Treat service providers with respect
  • Not misuse the booking system (e.g., making bookings with no intention to attend)

6. Bookings and Cancellations

  • Bookings made through the Platform are agreements between the Customer and the Business
  • Gapli facilitates bookings but is not a party to the service contract between Customer and Business
  • Cancellation policies are set by individual businesses and will be displayed at the time of booking
  • Repeated no-shows may result in account restrictions

7. Payments

Payments are processed securely through our payment provider, Stripe. By making a payment, you also agree to Stripe's terms of service. Gapli does not store your credit card or banking details. Refund policies are set by individual businesses. In the event of a dispute, we will work with both parties to reach a fair resolution.

8. Subscriptions and Fees

Business Users may be required to subscribe to a paid plan to access certain features. Subscription terms:

  • Free trial periods may be offered at our discretion
  • Subscriptions renew automatically unless cancelled before the renewal date
  • You may cancel your subscription at any time through your account settings
  • Refunds for partial billing periods are not provided unless required by law
  • We reserve the right to change pricing with 30 days' notice

9. Intellectual Property

All content, features, and functionality of the Platform (including but not limited to the design, text, graphics, logos, and software) are the exclusive property of Gapli and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

10. Prohibited Conduct

You may not:

  • Use the Platform for any unlawful purpose
  • Attempt to gain unauthorised access to the Platform or other users' accounts
  • Interfere with or disrupt the Platform or its servers
  • Upload malicious code, viruses, or any harmful content
  • Scrape, harvest, or collect information about other users without consent
  • Impersonate another person or entity
  • Use automated tools to access the Platform without our permission

11. Limitation of Liability

To the fullest extent permitted by law, Gapli shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid to Gapli in the twelve (12) months preceding the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Platform will be uninterrupted, secure, or error-free. We do not endorse or guarantee the quality, safety, or legality of services offered by Business Users.

13. Account Termination

We may suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we determine is harmful to the Platform, other users, or third parties. You may delete your account at any time through your profile settings. Upon termination, your right to access the Platform ceases immediately.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the applicable laws of the member state in which our registered office is located. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, without prejudice to your rights under EU consumer protection laws.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 30 days before they take effect. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
